EU-US Safe Harbor

Sort of astounded when I read it on news yesterday morning. First learnt of that safe harbor arrangement from the CISSP curriculum, but now it is essentially defunct.

Not sure if it was on anybody's exam but it's interesting to see if that happens to appear on exam going forward.

Also, just curious if anybody is already affected by that court decision?

To be honest, it's actually not surprising to read it. I (we) within our company and other associations that I am affiliated have been tracking that development for some time. Generally speaking, I would not have been a proponent of using the Safe Harbor as a protection anyways. I favor the model contractual clauses.

But I saw it in Snapfish privacy agreement once.

I've seen a few job listing with a Safe Harbor being one of the requirements.

It's having an impact on US-cloud providers and anyone in the EU who wants to use them. So when I am back from vacation next week it will cause a lot of discussion at clients.

However: that agreement was weak anyway, and no EU company in a regulated area (e.g. dealing with health data) could rely on them. So it's more a worrying indication that the legislative mood is shifting than a immediate issue, at least for my clients so far.

Well the court has to address a few things but the basic idea is yes, you can essentially throw the treaty out but other controls will need to be put in.

Actually more interesting news revolves around Hi-Tech. Some of the rules will simplify but the software certification will be a bit harder to... well certify. New rules go into effect 16Jan16. Only 540 pages of government written goodness there.

I have done my reading and now I need a Government inspired nappy.
