Banner MOTD

Is anyone familiar with the Banner MOTD story?
The one that says a court ruled that it was not illegal to hack into a switch/router as the owners did not have a warning message prohibiting unauthorised access.

Do we know if this is fact or otherwise?

I've tried searching online for the story but haven't found anything yet.

I learned about it from the CBT Nuggets.

Think it was in a university, some students broke in, University found out, tried to prosecute them, and lost.

Another part is that you should never have "Welcome to <blah>" as the MOTD because that counts as an invitation. No idea if it really counts in legal terms or not but best not to risk it IMO.
