Boss problem

Currently i am in desktop support,my friend who is an MBA works in a company where he did his internship as he had a good relationship with the boss who is also the owner, as he considered him a friend he trusted him, he and his colleagues who joined with him was not given appointment or offer letter as the boss kept giving them excuses, finally a colleague of his managed to get the offer letter after coercing the boss,now my friend who is working for 1 year with this company got a shock of his life when he read the offer letter,colleague of his did the mistake of signing the document, the document states that they are not empoyees but a intern who has to work on a contract of 2 years, after that there would be a probation of 4 months then there would be a exam and then if they i mean 'he' like the performance then he will give him all the benefits of an employee, now the HR has left the company and the owner looks after all these matters, the problem is my friend has not got the appointment letter and if he will try to resign the boss will obviously bring up the matter of him not having the official MBA certificate and might force him to sign that new offer letter, many of his colleague is contemplating resigning so what should he do as he wants to properly resign without burning bridges and does not want to omit this 1 year experience

You say he's an MBA, but he doesn't have "the official MBA certificate".....so he has an MBA or....?

Are contracts like that allowed in first place? I do not know where you are based but in the UK it is illegal to give bad feedback about an employee so this keeps the employee employable when they decide to leave. Put it this way no-one likes to be dumped so if they relied on feedback from the employer before hiring someone we would not have the jobs we have. An employer can only refuse to offer feedback about employer and then the new employer can ask you the employee if they interested why your previous employer has done that.

If you/colleague are not happy with contract conditions I would advise you leave if you feel there is better opportunities there and you can try to explain to the new employer that you are after a secure job and a company you feel can expand your career because a 2 year intern is just not on.

Not to sound like a douche, but can you please edit that post to have some sort of correct punctuation... Even if it's not exactly correct - something to just show you tried.

Also, you said he's an MBA, but then said he has no certificate... So, is he an MBA or not?

The longest I've worked without an offer letter was one day. And in that case, I wanted that experience, even if there were no pay nor recommendation letter. This was almost certainly a mistake and something to learn from.

Whether or not to resign is your friend's decision. It doesn't matter at all what his boss chooses to bring up.

Whether or not to sign the offer letter is again your friend's decision. He, and his colleagues, can't be forced to sign anything.

So what should he do as he wants to properly resign

He politely tenders his resignation and gives his two weeks' notice.

He should list that one year of experience. He can't control what sort of reference his boss will give to future employers. There's no sense in losing sleep over things you can't control. He should do his best with respect to what he does control--act professionally, resign properly, provide better references from his colleagues, and explain any negative feedback.

First of all i want to apologize for the confusion, I was getting late for work and english is not my native language. Thanks to all for their patience and effort to understand what i was trying to say. Thanks vcole for the effort. so to start, my friend has some formalities to complete with his college and will get the official certificate/degree whatever, may be around June this year and yes he is an MBA. When he was studying for his MBA he did the internship for some months and was given the job once he completed his MBA. Even he agrees that it was a big mistake accepting the job with verbal assurances. His boss is acting weirdly lately, like getting angry on small matters and he is sure he will make a scene and won't allow him to resign peacefully. I did advised him to at least have a word with him. So my question is if he leaves the company and goes for an interview and explains to them that this is the reason he left the company, don't you think they will doubt him and will rather have someone with clean experience record ?

From your description, it looks like it might be tough to leave without burning a bridge. If the boss is being "not cool", there's not much he can do about that. Your friend has got the experience under his belt, and that's that. There's no reason to omit it or try to hide it, even if it doesn't end well. It sucks that confrontation might not be avoidable, but that's a part of life. Best thing he can do is play it cool and not lose his head. Better to quit calmly than to storm off the job.
