Looks like it's a federal law under the Fair Labor Standards Act and if you're only getting paid for a 40 hour work week then you're entitled to overtime pay or a higher salary. You have to be making at least $455/week and you would only be making $400/week at $10/hr and 40 hours/week. -

Thanks W. Stewart for the link. It would appear that as long as I am making $11.38/hour salary I could be exempt from being "guaranteed" overtime pay. We will see. I am still working my butt off here for both my employer and my self. I see the next 5 months (tomorrow is one month here) as my time to prove my worth.
