Okay. That is just beyond stupid. Way to set an awful precedent which will cause all the criminals out there to have a field day.

After reading more about the case I think it is horse sh*t. He admitted to it then tried to say that his niece's social is close to what he was using and that is what he was doing. The fact that they knowingly used the number to obtain credit should have satisfied the requirement for capacity (the ability to receive). They used a fictitious SSN to obtain a loan for a car. I hope they nail this guy on something and Colorado rewrites it's law.
