A wireless access point, by itself, operates both at the physical layer and the network layer. The broadcasting of 802.11x radio signals is a physical layer attribute, and the translation to 802.2 and 802.3 is a datalink layer attribute. Heres a simple way to remember if a device operates at least at the datalink layer, if it has a MAC address, it will at least be in the data link layer, maybe more layers, maybe not.

If it were a wireless access point/router it would operate at layers 1-3.
